General Terms and Conditions (GTC) of Midwife Elina Eichel
I. Scope of Application
Unless otherwise agreed, the General Terms and Conditions apply to my contractual relationship with the client.
II. Legal Relationship
The legal relationship between me and the client is governed by private law.
III. Scope of services
The services are provided on the basis of the midwifery assistance contract pursuant to §134a SGB V (German Social Code), which was concluded between the professional associations of midwives and the GKV-Spitzenverband (National Association of Statutory Health Insurance Funds).
For self-payers: the range of services is based on the private fee schedule of the federal state in which the service is provided.
For agreed appointments that are canceled by the client less than 24 hours in advance, I reserve the right to invoice the client privately for the lost remuneration.
IV. Optional services
Optional services are services that are not covered by the midwifery contract pursuant to Section 134a of the German Social Code, Book V (SGB V) and are billed to the client privately, for example: • Laboratory tests that are not covered by the maternity guidelines • Courses • Osteopathic treatments • Taping
I undertake to inform the client of any additional costs before providing an optional service. Payment in advance may be agreed for optional services.
V. Remuneration for midwifery services
For clients with statutory health insurance, I will bill the statutory health insurance fund for the services. This does not include the agreed optional services. Clients are obliged to pay for these themselves.
Clients for whom a public corporation, institution, or foundation is responsible for midwifery services (e.g., those entitled to medical care) must submit a declaration of cost coverage from their cost bearer, which covers the services listed under No. III of these General Terms and Conditions. If this declaration of cost coverage is not available or does not cover the services used, clients are obliged to pay the costs themselves.
Privately insured clients are obliged to pay the costs of midwifery services in accordance with these General Terms and Conditions as self-payers. The scope of reimbursable services is based on the private fee schedule of the federal state in which the services are provided. The client is responsible for clarifying the reimbursability of services with her health insurance company. If the private fee schedule of the federal state in which the services are provided does not provide for reimbursement of services in accordance with the supplementary agreement to the contract for the provision of midwifery care pursuant to Section 134a of the German Social Code, Book V (SGB V), the reimbursement rates of the supplementary agreement shall apply.
The invoice amount is due within 14 days of receipt of the invoice. Reminder fees may be charged in the event of late payment.
VI. Courses
Services and conclusion of contract I offer various courses, some of which are anchored in the midwife assistance contract in accordance with § 134a SGB V (German Social Security Code) and some of which are agreed as optional services. The scope of services is based on the description on my website.
Registration Registration takes place online via the website www.hebamme-ellie-eichel.de. By registering, the client makes a binding offer to conclude a contract, stating their postal address. After registration, the client will receive a booking confirmation by email. If the maximum number of participants for a course has already been reached, the course cannot be booked online.
Payment of course fees For services that exceed the scope of the midwifery assistance contract in accordance with § 134a SGB V (e.g., the partner fee for birth preparation courses), the client will receive an invoice by mail from my billing service provider AZH. The invoice amount for the partner fee is due within 14 days of receipt of the invoice. The joint course place for the client and their partner can only be finally confirmed and participation enabled once the partner fee has been paid on time. The services for the client themselves will be billed separately after the end of the course directly to the statutory health insurance company. Reminder fees may be charged if the partner fee is not paid on time.
Self-payers Privately insured clients must transfer the course fee as self-payers. They must contact their private health insurance company themselves to find out whether the course fees will be covered. The same applies to the partner fee.
Cancellation by the client If a course that required advance payment (e.g., baby massage or partner fee) is canceled less than three weeks before the start of the course, a cancellation fee of 100% of the agreed fee hast o be payed.
Course cancellation or postponement If I am unable to hold a session myself for health reasons, I may have a substitute hold the session or offer an alternative date. If the minimum number of participants is not reached, I may cancel an event up to one week before the date. In this case, any fees already paid will be refunded.
VII. Right of withdrawal
As a consumer within the meaning of § 13 BGB (private individuals), the client has the right to withdraw from distance contracts in writing without giving reasons. A sample form can be used for the withdrawal, which should be addressed to:

The withdrawal period is 14 days from the date of confirmation of registration (conclusion of contract). If the client revokes the contract, I am obliged to repay all payments I have received in connection with the revoked service immediately within 14 days from the working day on which the notification of revocation of the contract was received. The same means of payment used by the client for the original transaction will be used for the repayment.
VIII. Rescheduling appointments
Due to the nature of my work, I am sometimes called to attend to unexpected emergencies and occasionally provide midwifery consultations in patients' homes. This may occasionally require me to reschedule appointments at short notice. In such cases, I will notify you as soon as possible and arrange a replacement appointment at the earliest opportunity.
IX. Liability
I am liable for midwifery services within the scope of the statutory provisions. I have professional liability insurance with adequate coverage for my activities.
